In accordance with current legislation, between a traumatic weapon and anyone wishing to purchase it, the need to obtain a special license inevitably arises. Carrying or even simply storing an “injury” without a license can result in criminal prosecution. Let's figure out how to get permission to traumatic weapon.

Documents for license

A license to purchase and use weapons is not so easy to obtain. It is necessary to convince those who will consider the application that there is no reason to refuse permission. In this regard, the list of documents required to obtain a license is quite extensive.

To obtain a “trauma” license, you must bring the following package of papers to the OLLR (to the police department at your place of registration):

  • a completed application with correct personal data and information regarding the presence of weapons;
  • 2 photos in 3x4 format;
  • a certificate confirming that the applicant has completed courses on the rules of handling weapons, as well as successfully passing the relevant exam;
  • a certificate from the clinic confirming that the applicant has no contraindications for the use of traumatic weapons (form 046-1);
  • passport of a citizen of the Russian Federation;
  • a copy of all completed pages of the passport of a citizen of the Russian Federation;
  • receipt of payment of the state fee for issuing a license for a traumatic weapon.

When submitting documents, the applicant must be given a coupon with a number and date.

Renewal process

Those who already have a license for “trauma” must renew it every five years. The renewal process is a simplified permitting process.

Extension of a permit for a traumatic weapon requires the submission of the following list of documents to the LRO:

  • completed license renewal application;
  • a photocopy of all completed pages of the passport of a citizen of the Russian Federation;
  • certificate from the clinic (form 046-1);
  • photo of the applicant in 3x4 format;
  • a certificate confirming that you have retaken the exam on the rules of handling weapons (at the request of employees of the licensing department);
  • a report from the local police commissioner that the requirements for storing weapons were not violated.

LRO employees review the application within one and a half weeks from the date of submission. The validity period of the extended permit is the same as the original one - five years. After this period, you must go through the renewal procedure again.

How to obtain a permit for traumatic weapons in 2020?

The process of obtaining permission for “trauma” can be divided into three stages:

  • submission of documents;
  • checking the storage location of future weapons;
  • registration of purchased weapons.

A person who has reached the age of 21, has successfully passed the exam on the rules of handling weapons and wishes to obtain a permit should apply with the above documents to the licensing and permitting department at the Internal Affairs Directorate at the place of registration.

On average, it takes OLRR employees a month to review the application. During this time, the district police officer checks both the applicant himself (personal conversations) and the reliability of the place of storage of his future weapons (inspection of the safe and place of residence).

The district police officer is most likely to approve the safe if it meets the following requirements:

  • made of metal;
  • wall thickness exceeds 3 millimeters;
  • firmly fixed;
  • has a secure lock;
  • exceeds the size of the weapon and its accessories.

After all the checks have been carried out, the district police officer writes a report and, based on all the documents provided, OLRR employees make a decision on issuing or prohibiting the issuance of a permit for traumatic weapons.

The permit remains valid for five full years from the date of receipt of the document. The license gives the right to purchase and use 5 weapons, no more.

In case of refusal, the applicant may appeal the decision of the OLRR employees in court.

The next step after obtaining permission is to purchase a pistol, revolver or other shooting device. After purchase, the license holder is given two weeks to hand over the weapon to the Internal Affairs Directorate for the next inspection - experimental shooting.

Together with weapons to the department of internal affairs next list documents for acquired “trauma”:

  • a completed application for a license to own a weapon;
  • a copy of the license to purchase a weapon with a seller’s mark indicating the fact of purchase;
  • spent cartridges, packaged in a special way + accompanying certificate from the manufacturer;
  • receipt of payment of the state fee for registration of traumatic weapons;
  • photo 3x4 format (2 pieces);
  • insurance issued upon receipt of a license to purchase an “injury”.

After submitting all the documents, the permit is finally issued to wear and the use of traumatic weapons, which will need to be renewed only after five years.

For military personnel

The process of obtaining a license for a traumatic pistol or other shooting device for military personnel is practically no different from that for ordinary citizens of the Russian Federation. The only difference is that instead of a medical certificate, military personnel must provide a certificate from the personnel department stating that the applicant is serving and has a weapon assigned to him.

The list of papers that must be presented to obtain permission for “trauma” for military personnel is as follows:

  • statement;
  • 2 photos in 3x4 format;
  • a certificate confirming that the applicant has completed courses on the rules of handling weapons, as well as successful completion relevant exam;
  • a certificate from the personnel department stating that the applicant is serving and has a weapon assigned to him (instead of a medical certificate);
  • passport of a citizen of the Russian Federation, a copy of all its completed pages;
  • receipt of payment of the state fee for issuing a license for “trauma”.

Otherwise, the procedure for obtaining a license is no different: after submitting the documents, a series of checks will take place, and then the registration of traumatic weapons and the issuance of the final permit.

By temporary registration

According to the current legislation, namely Article 13 of the Federal Law “On Weapons”, persons without permanent registration do not have the right to purchase, store and use traumatic weapons.

In this regard, there are only two options for those who still want to obtain a license:

  • obtaining permission at the place of registration;
  • Registration of permanent registration at the place of residence.

In both cases, the process of obtaining permission will not differ from that described above.

If you have a criminal record

Current legislation prohibits the possession of weapons by persons with an unexpunged and (or) unexpunged criminal record, as well as with an expunged/expunged conviction for crimes of high gravity committed with the use of weapons.

Thus, persons who have met the following conditions can apply for a “trauma” permit and still count on success:

  • the criminal record has been expunged or expunged;
  • the crimes for which the applicant was convicted did not involve the use of weapons.

If these conditions are met, the procedure for obtaining a license for a traumatic weapon will be the same as for citizens without a criminal record.

For a police officer

For police officers, the procedure for obtaining a license to use weapons is somewhat easier: they do not need to provide a certificate of completion of courses on the rules of handling weapons. Instead, information about the service weapon assigned to the police officer must be attached to the application.

The remaining documents, as well as the ongoing checks and procedures, are the same as those for ordinary citizens of the Russian Federation.

What is the price

If we consider only the cost of obtaining the license itself, then it will cost the price of the state duty, namely 110 rubles per unit of weapon (respectively, 220 for two units and 550 for the maximum available five units). Renewing a license will cost less: only 30 rubles per weapon.

To acquire a traumatic pistol for safety reasons, a Russian citizen needs a license for a traumatic weapon, and to carry it legally, a permit is required. Let's look at the procedure for obtaining these documents, tell you what you have to do and how much the right to self-defense using trauma will cost.

What traumatic weapons do not require a license?

In accordance with the Law “On Weapons” 150-FZ, in the Russian Federation the types of self-defense weapons that civilians are allowed to have are divided into licensed and unlicensed.

Without permission and license, persons residing in the country have the right to buy and carry:

  • Mechanical gas atomizers, i.e. any gas cartridges, regardless of the substances they contain (including pepper, etc.). A restriction is imposed on their use: not allowed in enclosed spaces, in buildings with big amount people inside, outdoors in strong winds;
  • Gas pistols with caliber up to 4.5 mm. Like the previous type, they should not be used in crowded areas, because the owner risks exceeding the necessary self-defense;
  • Stun guns with a power of up to 3 W, equipped with protruding electrodes;
  • Pneumatic pistols with a caliber of up to 4.5 mm with muzzle energy of up to 7.5 J;
  • Signal pistols and revolvers with a caliber of up to 6 mm;
  • Light and sound weapons that suppress aggression by influencing dangerous object through a sharp loud sound and a flash of light. The most famous example of such a self-defense device is AntiDOG, designed for short-term neutralization of dogs and some other dangerous animals;
  • Collectible (decorative) smooth-bore and/or edged weapons, subject to storage indoors exclusively as interior parts;
  • Variations of these types, combining the properties of 2-3 of them, for example, rocket launchers, which have both a signal effect and a possible impact on the aggressor with gas.

Information about the caliber and muzzle energy must be indicated in the certificate for any legally sold unit of pneumatics. In Russia, pneumatic guns with muzzle energy up to 3 J are most often offered as self-defense weapons, available without permission.

Types of licenses

The above-mentioned Federal Law-150 provides for three types of issued permits:

  • for storage;
  • for storage and carrying;
  • for storage and use.

The type of required permit that should be issued after purchasing a weapon is determined by the type of the latter.

There are no types of licenses, since a license is a permitting document for the purchase of weapons of the type specified in it. For further actions with the acquired weapon, it is envisaged to obtain not a weapons license, but a permit. These two documents should be clearly distinguished.

There are exceptions to this rule:

  • the types of self-defense weapons listed in the previous part of the article, as well as decommissioned emasculated weapons, do not require either a license to acquire or permission to perform any actions with them;
  • a license to acquire gas and signal means of self-defense, as well as edged weapons as an element of the national costume, plays the role of a permit;
  • To use a hunting rifle, on the contrary, permission alone is not enough - you must obtain a hunting license.

Where do you get a license for a traumatic weapon?

To obtain a weapons license, you will have to pay a visit to the Licensing and Permitting Department (OLRR) of the territorial administration of the Russian Guard, which serves the area (settlement) in which the person wishing to acquire a weapon lives. A citizen who, contrary to current Russian legislation, does not live at his place of registration, is forced to go to a government agency that serves the area where he is registered.

It is recommended that before you start filling out all the required papers and going through the authorities, you personally visit the OLRR to make sure whether they will give you permits for trauma, ask about the procedure for their registration and receive comprehensive official explanations on all issues.

Be prepared that it will take up to three months to collect the full package of papers.

What documents are needed to obtain a permit?

To obtain a personal injury license you must submit:

  • an application drawn up in a standard approved form;
  • a copy of the passport or an identity card that replaces it;
  • two 3x4 photo cards;
  • a check from the bank's cash desk confirming payment of the state duty.

In turn, to obtain a permit for a traumatic weapon, you will need:

  • medical certificate 046-1;
  • an act from the local police commissioner confirming the presence in your residential premises (at your place of registration) of a safe or a special cabinet for storing a pistol;

Before applying for a permit, you will have to spend time and money on training in an accredited organization, undergo a medical examination, buy and install a cabinet/safe that is firmly attached to the wall and locked with a combination lock, and contact the local police officer to come to the owner of the injury and executed the said act.

Training costs approximately 5 thousand rubles. If the exam cannot be successfully passed the first time, an unlimited number of retakes are allowed, but the “price of the question” is 1000 rubles. for every try.

The total cost of a medical certificate is 1,500 rubles.

The state fee for issuing a license is from 500 to 2000 rubles, and the OLRR can also charge additional fees. fee for her form - 50 rubles.

The state fee for issuing a permit for injury is 100 rubles.

How to renew your license

If within 6 months you, due to some circumstances (surmountable or insurmountable), have not managed to acquire a traumatic injury, your license will be automatically revoked. In this case, the renewal of the document is completely excluded, and you will have to go through the entire procedure of its registration again - from scratch.

As for the permit for trauma, it should be renewed three months before its immediate expiration using a procedure identical to its receipt.

Rules for carrying traumatic weapons

The traumatic pistol should be worn:

  • only in a sheathed holster;
  • set to fuse;
  • without a cartridge in the chamber;

Of course, the owner of a traumatic weapon must always have a permit and identification card with him.

We must not forget about the principles of using traumatism. We must in every possible way avoid exceeding permissible self-defense, causing unjustified harm to objects that pose a danger, and correctly assess the degree of threat that comes from them. Otherwise, you can get a criminal record even if you are completely confident in your innocence, since the investigation and the court do not always share such confidence. Keep your head cool, try to avoid shooting, use the gun consciously and when really necessary.

What happens if you carry a weapon without permission?

A citizen who does not have a permit for a traumatic weapon of defense is subject to administrative liability under Art. 20.8 Code of Administrative Offenses of the Russian Federation.

Previously, this was punishable by criminal charges under Article 222 of the Criminal Code, but recently only the illegal sale of traumatic drugs falls under it.
