Who is eligible for a license?

There are no specific restrictions in the legislation of the Russian Federation on obtaining a license for the removal of solid waste, therefore a permit can be issued to both a legal entity and an individual.

At the same time, the government decree clearly states that an individual must necessarily have the status of an individual entrepreneur. Otherwise, he has no rights to enter into contracts.

The period during which the act of granting rights to remove solid waste is considered can range from a week to a month and a half. Moreover, the organization that submitted the application may undergo several inspections during this period. Their task is to check compliance with all the rules established by the regulations and the readiness of the institution to enter into an export agreement.

Act of obtaining a license

It is impossible to obtain permits without fulfilling the conditions established by the regulations and the Government Decree on waste management.

To obtain a license for the removal of solid waste, the regulations create the need to submit documents that the organization has:

  • Specialized equipment: machinery and vehicles equipped with means for loading and transporting solid waste.
  • Personnel who have previously completed training courses in handling solid waste, which is confirmed by the presence of a special certificate.
  • An act with a sanitary and epidemiological conclusion confirming compliance with all sanitary rules for the property that the applicant will use in its future activities.

To begin the procedure for obtaining a license, it is the applicant’s responsibility to submit an application to Rosprirodnadzor, attaching the information described above to the application.

The act of filing an application must be accompanied by the following data:

  2. Address of the actual residence.
  3. Identification codes (OGRNIP for individual entrepreneurs) and registration certificate numbers.
  4. Addresses of licensed places.

Legislation in the field of licensing the removal of solid waste

The last 5 years have become a new stage in legislation in the field of waste management. The new regulations did not bypass the area of ​​licensing and concluding contracts for the transportation of waste materials.

The Government Decree of January 1, 2015 actually sent the abbreviation “MSW” into the past. After the act was adopted, it was replaced by MSW - solid municipal waste, which in essence is not much different from household waste.

Garbage removal license

The collected documents are submitted to the licensing authority in the locality where the individual entrepreneur is registered or the legal address of the enterprise is located. This must be done within 5 days after submitting the application. The relevant organization has 60-90 days to consider the application.

Re-registration and extension

If an entrepreneur or organization changes the location of a licensed facility or the class of exported waste, it is necessary to notify the licensing authorities within 2 weeks. The notice must be given in writing.

Routine inspections of waste disposal facilities are carried out annually. The inspection organization is obliged to notify the entrepreneur about this at least 10 days before the expected date of the visit. The duration of work to monitor and verify the activities of an entrepreneur or company should not exceed 30 days.


Based on the results of the research, acts are drawn up and signed by all members of the commission. If an individual entrepreneur disagrees with the conclusion, he can reflect this in the act.

If during an inspection the commission reveals violations, it issues an order to eliminate them within a certain period. Reasons for license suspension may be:

Within 5 working days, Rosprirodnadzor checks the completeness and accuracy of the information contained in the specified application and documents, including checking the compliance of the license applicant with the licensing requirements, in the manner established by Art. 19 of the Federal Law and makes a decision on granting a license or refusing to grant it.

If the package of documents has been completed correctly and the license applicant meets the requirements, then, within a period not exceeding forty-five working days from the date of receipt of the application for a license and the documents attached to it, the licensing authority checks the completeness and accuracy of the information contained in the specified application and documents, including checking the compliance of the license applicant with the licensing requirements, and makes a decision on granting a license or refusing to grant it.

Licensing requirements for carrying out activities in the field of waste management.

  • 1. Licenses of sanitary and epidemiological conclusion on compliance with sanitary rules for buildings, structures (including waste disposal facilities) and premises owned by the applicant by right of ownership or on another legal basis and meeting established requirements
  • 2. Licenses for equipment (including special) and installations owned by the applicant on the right of ownership or on another legal basis, necessary to perform the declared work and meeting the established requirements

  • 5. The applicant has a developed and approved production control system in the field of waste management;
  • 6. Conducting by the applicant monitoring of the state and pollution of the environment in the territories of waste disposal sites and within the limits of their impact on environment in accordance with paragraph 3 of Article 12 of the Federal Law “On Production and Consumption Waste”;
  • 7. Recovery of substances that destroy the ozone layer from waste before their burial in production and consumption waste disposal facilities in accordance with paragraph 2 of Article 51 of the Federal Law “On Environmental Protection”. the licensee has passports for waste of hazard class I - IV, in relation to which activities are carried out for their collection, use, neutralization, transportation, disposal;
  • 8. The presence of a license applicant in accordance with the Federal Law "On Environmental Expertise" of a positive conclusion of the state environmental expertise of the design documentation of facilities associated with the disposal and disposal of waste of hazard class I - IV, in the event that the license applicant intends to use such facilities to carry out activities for the collection, use, neutralization, transportation and disposal of waste of I-IV hazard classes, with the exception of those facilities that were put into operation or the construction permit for which was issued before the entry into force of this Resolution.

Responsibility for operating without a license

For carrying out this type of activity, administrative liability is provided under Article 14.1. Code of the Russian Federation on Administrative Offences.
